Terms of Service

1. Agreement to Terms

By creating an account on GymOptic ("the Service") and checking the acceptance box, you confirm that you have read, understood, and agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these Terms, you must not access or use the Service.

1.1 User Age Requirement

GymOptic is engineered for adult athletes. By creating an account and using the Service, you represent and warrant that you are at least 16 years of age. We do not knowingly collect or process personal data from anyone under the age of 16. If we discover that an account has been created by a user under this age limit, the account and all associated data will be immediately and permanently erased from our servers without notice.

2. Performance, Recovery & Nutritional Disclaimer

GymOptic is not a medical device or a substitute for professional medical advice.

You acknowledge that weightlifting, physical exercise, and breathwork practices carry inherent risks. You assume full responsibility for your use of the Service.

Algorithmic Suggestions (Iron Engine): The "Ghost Suggestions" for weight and reps are generated by a mathematical algorithm based on your past logs and inactivity periods. They are strictly tools for data visualization and tracking convenience. They are NOT personalized coaching, medical advice, or safety limits. Always use your own judgment and listen to your body.

Performance Estimates: Calculations regarding "Training Load", "Volume Tolerance", and "Calorie Estimates" are mathematical approximations based on your logged activity and selected profile settings. They are not physiological measurements or health diagnoses.

Fuel Engine (Caffeine Tracker): The Fuel Engine estimates active caffeine load using abstract mathematical decay models. It provides zero medical inference and must not be used to assess health, sleep quality, stress levels, or actual physical capacity. All caffeine data remains strictly on your local device.

Rest & Mobility Tools: The "Focus Breath", "Cool Down", and other timers provided within the Service are mechanical pacing tools designed for performance optimization. They are NOT intended to diagnose, treat, or prevent any medical condition (e.g., anxiety, hypertension, or respiratory disorders). Always consult a healthcare professional before beginning any new breathing protocol.

3. Your Account & Data

  • You are responsible for safeguarding your password and account credentials.
  • You must provide accurate information (e.g., email) to ensure proper account recovery.
  • Data Minimization Statement: We collect only the data absolutely necessary to provide core app functionality (logging workouts). No sensitive health data, location data, or contact lists are collected, processed, or stored.
  • Local Data: Machine Photos taken within the Service are stored exclusively on your device (browser storage / IndexedDB). GymOptic does not store these files on servers and cannot recover them if you clear browser data, lose your device, or reinstall the Service.
  • Email Use: Your email is used solely for account login, password recovery, and essential communications. It will not be sold, shared, or used for marketing without your explicit consent.
  • Data Liability Clause: Because of our strict local-storage (IndexedDB) and zero-retention policies, if you activate the 'Kill Switch' or clear your browser's local cache, your data (including machine photos) is permanently destroyed. We cannot recover it for you. You assume full responsibility for backing up any data you wish to keep.

4. Termination & Inactivity

GymOptic may suspend or terminate your account if you materially breach these Terms, misuse the Service, or if required by law.

Account Auto-Deletion Policy
  • Ghost Accounts: Accounts created more than 30 days ago with zero logged activity (no workouts, no profile setup) will be permanently deleted to prevent spam.
  • Dormant Accounts: To ensure data minimization (GDPR), accounts with no login activity for 24 months will be scheduled for permanent deletion.

5. Limitation of Liability

To the maximum extent permitted by applicable law, GymOptic shall not be liable for indirect, incidental, special, consequential, or exemplary damages, including damages for loss of profits, use, or data. Nothing in these Terms limits liability for death, personal injury caused by negligence, fraud, or where such limitation is not permitted under applicable law (e.g., EU Consumer Law).

6. "AS IS" and "AS AVAILABLE" Disclaimer

The Service is provided on an "AS IS" and "AS AVAILABLE" basis. Except where prohibited by law, GymOptic makes no representations or warranties of any kind regarding the operation or availability of the Service.

7. Governing Law

These Terms shall be governed and construed in accordance with the laws of Denmark (EU), without regard to conflict of law provisions.

8. Changes to Terms

GymOptic may update these Terms from time to time. Material changes will be communicated via email or in-app notification. Continued use of the Service after changes constitutes acceptance of the updated Terms.
